Terms of Business - On The Beach Transfers

All bookings are made subject to the following terms and it is your responsibility to ensure that you have read, understood and agree to the following: When making your booking we will arrange for you to enter into contracts as agent for the supplier, for transfers between the departure points and destinations specified in the written confirmation issued by On The Beach Transfers.

On The Beach Transfers

On The Beach Transfers is a trading name of On The Beach Limited a company registered in England, whose registered office address is Park Square, Bird Hall Lane, Cheadle, SK3 0XN. Its company registration number is 03162982.

On The Beach Transfers is at all times acting as the duly authorised agent of the supplier detailed on your written confirmation. As agent we accept no responsibility for the acts or omissions of the Principals or for the services provided by the Principal. The terms and conditions applicable to the contract are those of the supplier and we advise you to read these conditions carefully as they do contain important information about your booking. Please ask us for copies of these if you do not have them. In the event of a difficulty with your booking, we will do all we can to assist you to resolve the matter. Ultimately however the contract is between yourself and the Principal listed on your voucher.

Introduction

The general terms below are in addition to the Terms and Conditions provided by the supplier.

The purchaser of the transfer services specified in the written confirmation referred to as "you" and "your" in these Booking Conditions mean all persons named on the booking (including anyone who is added or substituted at a later date). "We" "us" and "our" mean On The Beach Transfers

Booking

Where there is more than one person in a booking, the person making the booking as the Lead Party shall be deemed to have done so on behalf of all members of the party and he or she accepts these terms and conditions on behalf of each member of the party. By clicking to book and entering your personal and payment details on our website, you are making us an offer to purchase the product on your behalf. At this point we immediately re-contact the Principal. Each Principal will require a short period of time to confirm that your chosen transfer is available. Although the email confirmation sent to you is NOT contractual acceptance of the Principal's ability to provide this product, it is an acknowledgement that we have received your offer, and should the product be available as detailed on our website then you have entered into a legally binding agreement to purchase this product subject to the suppliers Terms and Conditions. In the event that we are unable to allocate your booking request to a supplier, we will send an email to advise you of that fact. An alternative may be offered which may include additional charges.

Once we have received confirmation from the supplier, we will contact you via email to let you know that your order has been booked. The contract is formed when the supplier issues its confirmation invoice and their booking reference number. Please note that once your booking has been confirmed to us, you can only cancel the booking in accordance with the relevant suppliers terms and conditions which may involve cancellation charges. Equally you may also be subject to our cancellation charges to cover our administration costs.

Prices and Payment

Details of prices for the service are displayed on our website. Prices quoted are per vehicle except in the case of shuttle transfers where per person rates are quoted. You must pay by debit or credit card at the time of booking. Card issuers charge us a handling fee and we will pass this on to you. On receipt of such payment you should receive a booking summary within 48 hours of your booking request being made. In most cases bookings will be confirmed by email only. We cannot be held responsible where an email does not arrive with you. Unless you have received an email notifying you that your order has been cancelled you must not assume this to be the case. The booking written confirmation acts as the voucher and must be presented to the representative of the supplier for both the outward and return journeys. Upon receipt of the transfer voucher it is important to carefully check the details of your booking. Should the need arise to amend or cancel your booking, an amendment or cancellation fee may be charged (see below).

All payments made for transfer bookings are non-refundable unless the supplier of the transfer cancels the transfer booking for any other reason than national strike action or Act of God.

Late bookings
Bookings can be made up to 48 hours before departure. Bookings can only be made online or by contacting our call centre on 0871 474 3000.

Transfer Provider Arrangements

Child Seats
The EU directive 2003/20/EC states that children must use an appropriate child seat until they reach 12 years of age or until they reach a height of 135 cm. However there is an exemption for licensed taxis. If no child seat is available, children of three years of age and over may travel as long as they wear an adult seat belt. Children under three years of age may be transported without a safety restraint as long as they travel in the rear of the vehicle.

Child Pricing
On shuttles, taxis and private transfers all children and infants count towards the occupancy of the vehicle, regardless of age, and thus should be included in the total number of passengers at the time of booking. If a child seat is required, we strongly recommend that you bring your own due to the variation in quality and availability across destinations. In some areas we can request local child seats on your behalf. If a child seat is provided by the transport company a charge will apply.

Wheelchairs
Unfortunately our transfers are not suitable for anyone who cannot climb the steps into a coach or minibus.

Baggage allowance and declaration
All baggage is required to be clearly labelled with the owners name and the destination address. Each passenger named on the written confirmation is entitled to an allowance on the relevant transfers of up to two items of baggage, i.e. one suitcase which should not exceed 70cm x 40cm x 20cm and one piece of hand luggage. Carriage of any baggage exceeding these measurements will be subject to available baggage hold space and may be declined. If a passenger requires carriage of baggage in excess of this allowance (e.g. suitcases exceeding the maximum permitted size, golf clubs, surfboards, wheelchairs/scooters etc) we must be informed at the time of booking. The supplier may levy a charge for excess baggage, which must be paid prior to transportation, or to refuse carriage of the excess items. All vehicles used by the suppliers are fully insured for passenger and third party claims, as required by the local law. Passengers baggage is, however, carried entirely at their own risk and no responsibility can be accepted for loss or damage.

Your Responsibility

It is your responsibility to travel with the booking voucher which lists arrival instructions and all the relevant local contact numbers in the event of an emergency. Neither us, nor the supplier will accept any responsibility for any loss of service or other loss should you not travel with your booking voucher.

Upon booking your transfer through On The Beach Transfers you accept responsibility for the proper conduct of yourself and your party during the transfer. The transfer supplier, its drivers and appointed agents reserve the right to refuse to carry any person due to your/their misconduct, within their reasonable opinion. No refunds will be made in these circumstances and the transfer provider will be under no obligation to pay compensation or meet any costs or expenses you incur as a result of the resulting termination of your booking.

If your actions or those of any member of your party cause damage during the transfer, you agree to fully indemnify us against any claim (including legal costs) made against us by the transfer owner and you are also liable for reimbursing the transfer provider for any damage caused, before you arrive at your destination.

In the case of any unusual delay with luggage one of the party should go to the arrivals hall and inform a representative of the supplier. If you fail to do so you may be considered a no show and the transport may depart without you. No refunds will be made in these circumstances.

If clients have difficulty in finding their transport vehicle then they should contact the emergency contact number on the booking summary.

If your arrival flight is diverted, we recommend that you contact your nominated supplier on the telephone numbers provided. Whilst every effort will be made to accommodate changes of this nature, an additional charge maybe applied. Please refer to the suppliers booking conditions for further details. Subject to their terms and conditions, it is the responsibility of the airline to transport you to your original destination.

Any flight delay or flight time changes must be notified to the transfer provider so that any necessary adjustments can be accommodated.

Resort to airport transfers must be reconfirmed during clients stay in resort at least 48 hours in advance. Where customers have not received confirmation of their inbound transfer they must contact the resort office for confirmation of pick up time and details.

Where any taxi is required to wait at the request of the customer, the customer will be charged a fee equivalent to 25 per hour or part thereof which will be settled locally with the taxi.

All claims relating to any issues with the transfer service must be brought to the attention of the suppliers representative at the time of the occurrence in the destination in order that the supplier may solve the problem. Any claim or refund to customers on behalf of the supplier can only be made with the written authorisation of the supplier.

Force Majeure

Under circumstances of Force majeure neither On The Beach Transfers nor the supplier will be responsible for compensation if we or the supplier have to cancel or change any service because of any unforeseeable circumstances beyond our or the suppliers control. These include (but are not limited to) accidents or any related delays, acts of terrorism, war, threat of war or similar, acts of God, flood, earthquake or other similar natural disaster, fire or explosion, exceptional or severe weather conditions, delays arising from compliance with the requests of the police, vandalism and terrorism, industrial action by third parties, problems caused by other customers, other circumstances affecting passenger safety, road closures due to local fiestas or other events, properties that are not accessible to type of service booked.

In very rare cases the nominated supplier may drop or collect passengers from a different point other than the accommodation address if the carriage to the exact specified accommodation may cause unreasonable delay or inconvenience to other passengers. All resort to airport transfers will be from the place where clients were dropped off at the beginning of their stay.

Amendments to Bookings

Should you wish to amend or change your booking, confirmation must be received in writing from the lead named passenger. Any such request will not take effect until received by us.

Charges may be levied by the supplier and you will be advised of these. In addition, On The Beach Transfers will also charge a fee. Details of charges are set out below.

Booking amendments relating to any changes to your transfer such as flight numbers, timings, accommodation name or address in the same resort and mobile number can be made on our website free of charge up to 5 days before the first departure date. Any amendments within 5 days of the transfer must be made by email to admin@onthebeachtransfers.co.uk and an administration charge of £20 per booking will be applied.

For booking amendments which result in a change to the arrival or return dates, resort, number of passengers or vehicle size must be made by email to admin@onthebeachtransfers.co.uk at least 5 days before the initial departure date and a £20 administration fee will apply. If the amendment leads to an increased cost this must be paid by the customer at the time of the request.

All amendments will incur standard card fees

Amendments are subject to the booking conditions of the supplier who may charge amendment fees in addition to those noted above. Please see supplier booking conditions.

Cancellation

In order to ensure the very best rates for resort transfers, all of our transfers are payable in full at the time of booking. As such, cancellations at any stage incur full loss of all monies paid for the service.

Complaints procedure

We hope your travel arrangements run as smoothly as possible and you enjoy your time abroad, however if you feel the need to complain you must immediately inform a representative of the supplier whilst you are abroad. Since your booking is a contract between you and the relevant supplier, they will have absolute discretion in deciding how to deal with your complaint. Insurance

We recommend that all passengers take out adequate travel insurance. It is a condition of booking with most Principals that adequate insurance cover is arranged in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your own needs. We can introduce you to suppliers of suitable cover if required. We accept no liability arising from your failure to obtain adequate cover. If you have booked your insurance through a supplier introduced by us, you will receive a confirmation policy document prior to travel.

Our responsibility

On The Beach Transfers is acting as a booking agent only and we have no liability for any of the transfer arrangements, and in particular no liability for any illness, personal injury, death or loss of any kind, unless caused by our negligence. Our responsibilities are limited to publishing information on our website about the services the suppliers supply, passing on reservation information to suppliers and informing you of any enforced changes to the terms of your booking. We accept no responsibility for any information about the transfers that we pass on to you in good faith. Any claim for damages for illness, injury or death arising from use of the transfer services, must be brought against the operator of the transfer services and will be under the jurisdiction of the law of the country in which the transfer is being made.

In the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of your booking (or the appropriate proportion of this if not all parties to the booking are affected).

Whilst all reasonable efforts will be made by the supplier, there is no guarantee that the vehicle will arrive on time in order to begin the transfer nor that it will reach its destination on time. On The Beach Transfers will not accept any liability in the event of such a delay.

General

We may alter these terms and conditions from time to time and post the new version on our website, following which all use of our website will be governed by the new version. You must check the terms and conditions on the website regularly. The terms governing the purchase of any Service will be the terms in place at the time of your order.

A person who is not a party to our agreement or the agreement with the Supplier has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of either agreement but this does not affect any right or remedy of another party which exists or is available apart from that Act.

If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be deleted but all other terms will remain valid.

Our terms and conditions and your use of our web site are governed by the laws of England and Wales, and in the event of any dispute under our contract, you agree to submit to the exclusive jurisdiction of the English courts.
